The LP version came with a free 12" single of the Italian Remix of "My Dying Machine." The A-side of this single was the vocal version, the B-side was all instrumental. Absolution may not be the most creative of Gary's works, but I enjoyed hearing a new track and the mixes of Magic. Maybe I like the Magic mixes because it's incredibly similar to Deadliner musically (although the lyrics are a bit different). I believe the Sacrifice material is some of Gary's best in years! You can find some familiar lyrics and noises from previous albums all the way back to some riffs that are reminiscent of Replicas material. Undoubtably, Gary is one of the best when it comes to recycling some of his own lyrics and sounds to create a new piece of work. Don't get me wrong, not everything Gary's ever done has been my favorite. The Dance album for example was IMO an all time low musically for Gary. Followed up closly by I, Assassin and Strange Charm, of course. In any case, Gary gets a big "thumbs up" for Sacrifice from me! All we need now is an American Tour!! Me being a musician myself with a CD just released, couldn't possibly have the audacity to be angered by someone making copies for friends of my disc if it weren't readily available to them . I would actually be happy because it would mean more people would hear my music. I love this digest and everyone involved in it. I've been a loyal Numanoid for 16 years and have purchaced Numan material in favor of eating and paying bills in the past just to have the pleasure of having whatever it was . So let's get off our moral high horses here and let fellow fans enjoy little things we all may not have . It's legal and we could all be happy . Numa approval would be nice though .So here it is and I hope it helps in our quest ! This issue has been argued back and forth for many years, with consumers groups arguing that this was a fair use (see Q8), and the recording industry arguing that it was not. The issue was finally settled by Congress when the Audio Home Recording Act (AHRA) (P.L. 102-563, 106 Stat. 4237, codified at 17 U.S.C. 1001 - 1010) was passed in October 1992. This Act added a ten sections to Title 17, one of which provided an alternative to the fair use analysis for musical recordings. The new section states: No action may be brought under this title alleging infringement of copyright based on the manufacture, importation, or distribution of a digital audio recording device, a digital audio recording medium, an analog recording device, or an analog recording medium, or based on the noncommercial use by a consumer of such a device or medium for making digital musical recordings or analog musical recordings. 17 U.S.C. 1008. As the legislative history to this statute noted, "In short, the reported legislation would clearly establish that consumers cannot be sued for making analog or digital audio copies for private noncommercial use." H.R. Rep. 102-780(I). Does this mean you can make copies for your family and friends, as long as it's not "commercial?" A strict reading of the words in the statute would seem to say that you may. This is not as outrageous as it sounds. Part of the impetus behind the AHRA was the perception that blank tapes were being used mostly to copy commercial musical sound recordings. As a result, the AHRA provided that a royalty payment (referred to as a "DAT tax" by its detractors) be paid for each sale of digital audio tape to compensate authors of musical works and sound recordings for the profits lost due to these copies. See 17 U.S.C. 1003, 1004. Arguably, the AHRA anticipates and allows exactly this type of copying, and a literal reading of section 1008 would tend to support this position. But the AHRA is still sufficiently new this hasn't been tested in court yet. As for my opinion of "Absolution" it is wonderful . Someone stated in the last digest that the beat we have been continually hearing is getting "tired" . Well I say if it's working for Numan and apparently it is , he can use that beat for the rest of his career ! I haven't been happier with Numan since Berserker . The argument that Numa has no control over their back catalogue simply because it is now out of print is ridiculous. So long as the label maintains a copyright over the material, they have the right to decide if they want to release it, when they want to release it, and how they want to release it. There are thousands of artists and groups (to say nothing of the labels) who have released music over many decades that is thus, now officially out of print. The fact that the material is no longer being pressed does not mean desperate fans have less culpability (or moral conflict) should they decide to make DAT or CD copies. Otherwise, the market would be flooded with illegally produced sources of old music now out of print. The argument that one is doing an obsucre artist a favour by making unsanctioned copies of their material is self-serving "logic." I didn't see much gratitude from all those musicians whose work was being reproduced illegally in China until recently. Granted, the Chinese pirating constituted a giant industry not entirely comparable to the issue here, but the logic behind the original argument was that illegal copies would be, in some way doing the artist a favour by exposing him/her to more people. Using this logic, the illegal Chinese pirating factories were doing an incredible favour to the industry. Strange, that industry didn't seem very grateful. It is presumptious as well, to assume that every artist would rather one have an illegal copy of their music than none at all. It could be just as likely, that most musicians would rather not have anything released at all unless they are receiving some royalty in return. This whole argument of doing the artist a "favour" is based upon assumptions concering the motives of the artist, the ability of the individual owner of a boot-CD to carry out their "favour" and ultimately is simply self-serving reasoning. Until one knows truly what Numa's position on this matter is, nothing should be done at all. The repercussions to the individuals involved in this venture in particular, to say nothing of the consequences that could befall the digest in general, are simply too great to chance. Me! I'm hoping Numa would agree to an arrangement like that, especially since most of us do OWN A LEGAL COPY of Berserker on vinyl. I'd also like to get Strange Charm (sigh), but the very first CD I bought was The Fury. Guess I got lucky on that one. As far as technical issues go, I work in the R&D deptartment of a rather high-tech company, and copying the entire CD to a hard disk, and then using that to make new CD-Rs would be a pretty simple job. We master CD-ROMs here quite regularly. And the booklets... Well, we have full-color copiers here, and enough computers, scanners, and color printers to make many art studios drool, so I'm sure I could do a great job, if permitted, or just a simple slip-sheet, just to really brand it as a knock-off. Blank recordable CDs are going for about $12 around here, jewel case included, so I'm thinking with that, a bit for the booklet, royalty to Numa, and priority mail shipping in the US($3 or so) would total less than $20. One is an import only, the other I want an import version. Yen - "Air" (have US release but want UK copy, cat no. EIRSACD 1034) Sharpe and Numan - "No More Lies" CD5 (was a UK release only) Yen supported Gary on tour and thanked Gary and his parents on the album credits. They were signed to IRS along with Gary and unceremoniously dumped when Gary left. If anyone can help me acquire a copy of these and put me out of my torment I'd be extremely grateful. The Yen is the bigger deal for me. I once a copy of "No More Lies" in my hand when I was not as completist in nature as I am now. Since I have acquired both the "I'm on Automatic" CD5 and the "Automatic" album CD, leaving this CD5 as the one I am missing. Sometime I may even spring for the "Famous People" CD for the 12" of Change Your Mind. That may be deleted now too. The fact that it's the same album but all -- I repeat, all -- the songs are extended. A few songs, like Scar, Magic, and Seed of a Lie, are even better than the originals IMO. I don't have the Absolution single, so I don't know if any of the Magic remixes are the same. Anyway, it's a nice treat for fans who think Sacrifice is his best work in 10 years; maybe surpassing Berserker! On another topic: is Numan a fan of Philip K. Dick? I've noted some references from 'Listen to the Sirens' and, of course, 'Call Out the Dogs' with its Blade Runner samples. If no one else knows what the Japanese lyric is in 'This Wreckage', I'll try to find out. So far, all i know is that the first symbol is in kanji and the rest are hiragana. The debate over private pressings of 'Berserker' continue... My views? According to the Numa policy, we should still be able to make those copies. Why? Well first, Numa allowed bootlegging in the past and has only decided to step in because fans were being ripped off. Therefore, are the fans being ripped off in this case? Second, Numa was upset by certain bootlegs because they had planned to release themselves the official, superior quality versions. Hence, they lose out in sales, and the fans are again ripped off. Therefore, is Numa still planning to release 'Berserker'? If not, where is the loss? That's my view. I agree we should await permission from Numa so we can avoid an legal confrontations. The royalty idea is an *excellent* compromise. And as long as there is no profit involved, this can only help Numa, Numan and his fans. As a postscript, I should ask another question. The first is, I recently purchased a cassette of Metal Rhythm that is on IRS records. The cassette that was stolen from me years ago was (I am almost sure) on Illegal records. Does this mean that I have a prototype New Anger that was released in the U.S. under the original title and track listing, or is my memory regarding my old MR cassette flawed. Did I read in Billboard (round about 1989, I reckon) that IRS had purchased the domestic rights (or whatever the hell it's called) to all of the old Numan stuff (would have been, oh, pre-'89)? Should I have started drinking at that time to justify my odd memory lapses? Has anyone ever suggested legitimately re-releasing the Numa catalog? Cd's are easy to press, and this is the age of DIY, no? Heck fire, kids, if The Fall can release all of thier shite on Matador (which saves me plenty o' dollars,by the way), why can't Numa release its back catalog on a small, yet quality minded label here in the states? It would help the label, and greatly aid dweebs like me who have to drive a minimum of 300 miles and shell out $big$ dollars for Numan music. I can see just by the response in this newsletter that fans can't get the discs, and I feel quite certain that there are many other fans who are not on line who are just as unfortunate. One of the best things about being a Gary Numan Fan is that he often records extended versions of his albums. The extended playing time of CDs allows him to bring these renditions to fans with greater ease than ever before when the only realistic choice was cassette tape. "Sacrifice (extended mixes)" continues the series after similar treatments for "Berserker", "The Fury", and "Machine and Soul". I should perhaps point out that these are extended mixes, not remixes. There are no dance remixes, dub mixes or 140bpm versions here. Gary does not change the songs radically when he does extended mixes. He adds more intro, instrumental breaks, verses, choruses, and maybe outro. This may disappoint those used to radical remixes. Myself, I like the approach, especially when the original songs are good. Remixes can work well e.g. the Zeus B. Held remixes of "Cars", or not so well e.g. some of the remixes on the 1993 "Cars" EP. Unlike "Machine and Soul Extended" this album contains no bonus b- sides. I was hoping to see an extended version of "Absolution" which might have squeezed onto this already generously timed CD, but no, this version covers just the album tracks with varying amounts of treatment. The packaging is very similar to the original. Only differences are '(extended mixes)' beneath the title on the front, and a different bar code number and spine title on the back insert. The inner pages of the booklet are the same as for the original "Sacrifice" CD. Going through the songs. "Pray" has extra intrumental interludes between vocal lines and a new intrumental bridge between the sung words and the "wah-ah-ooohs"; "Deadliner" is reworked more than most songs with a new intro before the original song kicks in at 2.20. Various parts of the original are explored more thoroughly. "A Question of Faith" has a new intro and new instrumental sections. "Desire" has a new intro section recalling later parts of the song. "Scar" is one of my favourites. It seems like he does more with this one than with most. There's even extra backing vocals on the chorus that adds a new dimension. This would make a good single IMO. "Love and Napalm" has injected into it extra passages of "Ah-ho-aohs" and some more prominent bass synth which was not so obvious in the original. "You Walk in My Soul" starts off with a much improved intro that evokes the sentiment of the song more effectively than the original. The "Magic" extended mix appeared on the "Absolution EP" and deviates little from the original bar some extra "ay-oh"s and intrumental passages. "Bleed" is identical as far as I can tell until 4.30 into the song when a percussion dominated break occurs. The "bass drum"/sample evolves until it thunders like an amplified heartbeat - a clever effect. Lastly, "The seed of a Lie", perhaps my overall favourite song from the original album, brings more of the haunting synth backing to the fore with extra intro and interludes. I wish the latter part of the song had been expanded too but it hasn't and keeps very true to the original. Still, it makes the song more affecting. I have not formed an overall opinion yet. I love the original album. It is still my first choice to go on the CD player even 5 months after its release. The extended mixes versions are conservative as one would expect. Some work much better than others (Scar, You Walk in My Soul, Bleed, The Seed of Lie). Others are less memorable. In some cases I wish some of the more uplifting or stunning instrumental parts were expanded or given greater prominence. That could have been simply euphoric to hear. So while this album is a very welcome addition to Gary's discography, I feel it could have been even better. It would have been difficult to top the original version. Maybe I was expecting too much. Still, I like it. Footnote: I ordered this CD through my regular dealer who was unable to get it this week but I could not resist picking up a copy I found at another store. I managed to acquire it rather painlessly; the record trader I always deal with just got one this past weekend at a record show and only wanted about $15 for it. I had some stuff I was going to trade him anyway so he let me do an even swap for no real expense. I think this is probably the only fair way to get it since apparently whoever he got it from didn't pay too much themselves. It's reasonably good sounding by live bootleg standards. Gary's voice sounds really strong and the low end is good. The guitars, however, are low in the mix. The song selection is a good cross section of Gary's best work over the years. Overall, I find its real value is as a preview to the legitimate set due out later this year, and I certainly do prefer a professional-quality recording to something like this. So if you can manage to get it without paying much and you're anxious to get an idea of what the regular release will sound like, it's not a bad deal. Otherwise, I think it's important to honor Gary's desire not to feed the profiteers. The real thing, when released, ought to sound really great. -Jon P.S. It contains the same tracks as the regular version but with all the songs extended. Unlike the _Machine & Soul (extended mixes)_ CD, this one does not contain any of the B-side songs that appeared on the two singles. It does not have an extended version of "Absolution" either. It runs for just over 71 minutes. This is 71 minutes of pure joy, or pure Sacrifice sounds. I found this CD to be tasteful and well done. None of these remixes go for anything showy or radically different from their shorter counterparts. Thus, the original feel of the album is maintained and enhanced by the longer versions. After criticizing Numan for not being daring enough with his "Magic Extended Mix" that appeared on the "Absolution" single last week, I now need to backpedal and admit to being wrong. Within the context of the entire album, these extended mixes, which emphasize mostly moody instrumental sounds, keyoards, and rhythms in the extended sections, make an impact on the listener by not being too daring and outrageous, thereby maintaining the same mood and atmosphere of the original CD. I was perhaps too harsh in condemning the extended mix of "Magic" on the single last week because, out of context of the whole album, it didn't do enough to please me. On top of that, I was upset that the single didn't feature any genuine B-side songs on it. By the last track of "Absolution," I was in serious need of hearing something new. Thus, the "Magic" remix, with its predictable extensions, felt like a real let-down. In the context of the entire extended mixes CD, the subtlty works wonders and makes this a fine CD to own. Standouts on the CD are "You Walk In My Soul", "Scar", "Bleed", and of course, "The Seed Of A Lie." I give this and Erland rating of +3. Buy and enjoy. If you liked _Sacrifice_, you will LOVE this.
