Dear Customer, SimpleNet has experienced a number of inquiries and complaints concerning the misuse of intellectual property, specifically property that is alleged to be protected by copyright or trademark laws. We have heard from the RIAA (Recording Industry Association of America) about the distribution of copyrighted song titles without the consent of the record label representing those artists to do so. We have been asked to take these actions when we find a site on our servers that may be in violation : The site owner has 48 hours to do one of the following : 1) Provide legal documentation of permission given to the site administrator to distribute the material from their site. or 2) Remove any material violating copyright or trademark laws. If you have received this notice, and you are not the site administrator, then please forward this notice to the person that is. If we do not here from the owner in the time period specified, we will suspend the account, and eventually cancel their service. If you are the operator of this web account, then you must respond to this notice immediately to let us know of your intentions. Thank you for taking immediate action to remedy this situation, SimpleNet. ========================= Robert adds that Simplenet had already suspended his account by the time he received this email. I've advised him to fight this but he seems to think the best plan is to simply move to a better and more-reputable web provider. If anyone is considering moving to Simplenet, I ask them to consider this first: 1) Robert was not given the 48 hours notice promised. 2) 48 hours notice is *FAR* too little to begin with. 3) There is no evidence that anybody at any of the record companies involved has complained of Robert's use of their material. This is the RIAA playing the heavy and Simplenet buying into it. 4) If this is how they treat Robert Eggleston, a man who runs a reputable site which GARY NUMAN HIMSELF LINKS TO FOR REALAUDIO CLIPS, then think how they might treat you. For the record, The World Wide Webb *IS* specifically authorized by Beggars Banquet to use their material here. We are not, however, authorized to use any material from Cleopatra, Eagle, IRS, Numa, or anybody else. My position here has not changed: our use of this material has always been in the context of promoting the sale of Gary Numan music and other merchandise, but that if any official request comes in asking for the removal of this material, it will be done. Several people connected to some of these companies have told me, OFF THE RECORD, that they don't have a problem with this - and I would presume they didn't have a problem with Robert's use of similar material either. Take your business elsewhere, folks. Simplenet can and will cancel your account without a valid legal reason to do so, and that means you *LOSE* any money you've prepaid. / From Joey Lindstrom joey@lindstrom.com / Interocitor Dot Net http://www.interocitor.net / / Friends don't let friends use Windows. ------------------------------ Date: Mon, 05 Oct 1998 21:13:26 -0500 From: Jeff Tolva Subject: Boots R Us To: numan@cs.uwp.edu Fellow traders, I have 14 bootleg audio tapes from the various "Exile" tours, including the recent one-off gig at Shepherds Bush Empire in London on Sept 12th. It is in fact the 12" version that is on the Numa Years release. There is an additional verse in it.. thew middle * section is extended and the transitions between the verses and chorus have an added keyboard line. The song also has a distinct end (i.e. an finale on the downbeat at the end) as opposed to the fade out on the original vinyl album version. On a different note, this same person that told me about the 12" version being the one I was hearing in the Numa Years box set asked a question about a compilation called "Black Heart" a month or so ago. I saw a copy of the CD at a local record store (2nd Avenue Records) here in Portland Oregon. It had the usual mishmash of reissued tracks with a few obscure ones. It had "Little Lost Souls" from the "Human" CD that Numan collaborated on. But here is the kicker... the last track is a song called "Black Heart" which I DON'T recall EVER running across. ANYONE hear of this track? Seems a hard choice to make to shell out money for tracks I have multiple copies of (do I need another copy of Cars?!?!?) just to pick up ONE new track, but would love to find out what this track is all about. Damrath" Subject: Favorite Numan Lyrics To: Gary Numan While we're on the subject of favorite lyrics... Some years ago, while I was living in upstate New York, I shopped a wonderful (now extinct) little record shop called "Collector Records" in Woodstock, NY. They had the delightful habit of ending up with alot of 12 inch extended singles of Gary's and I often ended up buying them before I could find the full album. One of the most enjoyable part of this experience was trying to decypher Gary's lyrics before seeing them in print. Some of these lyrics have remained somewhat of a mystery to me since their only printing (B-sides particularly) has been in releases such as the Asylum series where the translation was often pretty sad. One of the most memorable was "The Image Is" on the B-Side of the "We Take Mystery" 12 inch single. (Incidently one of my favorite songs of all-time). I always beleived the lyrics said: "Oh look at the smog and trash Tomorrow we'll be civilized and blow the whole world up." the Asylum 2 lyric sheet claims: "Oh look at the smile that cracks Tomorrow we'll be civilized and burn the whole world down." I also thought these lines went: "They're all so sincere But sing a song with life and they'll tear your heart." The Asylum 2 book says: "We're all so sincere I'll sing a song from the film That broke your heart." This song was full of examples, but those were the two that sprung to mind. Do any of the rest of you have other memroable examples of lyrical interpretations? I always find it a great, fun exercise to try to figure out what Gary is saying before I check the lyric sheet. I'm often quite surprised. Now I've got everyone's attention, I have 2 things to say. Could anybody sell me CDs of Sacrifice (extended), or Machine+Soul (extended-with the extra tracks on it). I already have the normal versions. Secondly, we don't seem to have had a poll for a while. This one is pretty simple. Just rank all of Numan's albums in order of preference from 1 to 16 (I'll include The Plan but not Human or Automatic as they're not pure Numan). Don't worry if there's a combination you can't decide between-for instance if your favourite 3 albums are TPP, Replicas and Telekon but can't decide which one is best then give them all an average rank of 2. This poll will generally decide which of Gary's albums is the best and worst among the fans. A good way to decide how to do this is to give each song on the album a mark out of 10 and find an average, and rank the averages, but you can use any method you like. I'm hoping everyone takes this seriously as a lot of other polls/discussion topics seem to have fizzled out. I'm hoping to get this completed by the end of November, and to get at least 50 or so responses. Oh-one more thing-when considering Telekon, include We Are Glass and I Die:You Die so all the singles are covered. Send your replies to me- James.Chapman@newcastle.ac.uk -not the digest! Another thing I just thought about- what to do concerning Metal Rhythm/New Anger. I have only heard MR so will just be judging that. If you have only heard NA then put that in your rankings as normal. But if you have heard both, I would prefer it if you just consider MR and not NA, as MR is the "proper" version of the album. Here is my ranking list: 1 BERSERKER 2 SACRIFICE 3 THE FURY 4 THE PLEASURE PRINCIPLE 5 STRANGE CHARM 6 I, ASSASSIN 7 TELEKON 8 EXILE 9 METAL RHYTHM 10 REPLICAS 11 DANCE 12 MACHINE+SOUL 13 TUBEWAY ARMY 14 WARRIORS 15 OUTLAND 16 THE PLAN If you send me your list like that, numbered and everything it will be easier for me to sort out. (my copy came complete with the original press release) The track was re-mixed and runs out to a whopping 8 minutes 28seconds!
